Visa condition 8503: No Further Stay
On this page
What does No Further Stay mean?
Home Affairs' waiver page describes it as a condition that "prevents visa holders from applying for most visas while in Australia". In practice, you would usually need to leave Australia before applying for another visa.
Your grant letter states whether it applies to you.
How do I know if I have it?
Can the condition be waived?
Home Affairs says a waiver "may be possible" in some circumstances, and has an online waiver request form. The form is for people who:
- are requesting a waiver of a No Further Stay condition on their current or most recently held visa
- are in Australia
- want to apply for another visa to remain
Important rules on the form page:
- Each visa holder affected by a No Further Stay condition must submit their own waiver request.
- Each form may contain only one waiver request.
What are the grounds for a waiver?
Its examples include:
- a serious medical condition affecting the holder or a close family member in Australia, supported by independent medical reports
- the death or serious illness of a close family member in Australia, where the holder's presence is needed
- natural disasters, civil unrest or war in the home country that developed after the grant and prevent departure
Circumstances you could have foreseen at the time of grant generally won't qualify. Policy can change.
What happens after a waiver request?
It does not extend your current visa or grant a new one. If your visa is about to expire, get advice about your options so you do not become unlawful.
It also says that if a waiver is refused, the condition stays, and there is no merits review at the Administrative Review Tribunal.
What should I do first?
- Check VEVO to confirm you have the condition.
- Check how long your visa lasts.
- Collect strong evidence if you plan to request a waiver.
- Get advice from a registered migration agent or lawyer before you lodge a visa application.
