Notice of intention to consider cancellation (NOICC)
On this page
What does the notice ask?
Two questions in character cases: do you pass the character test, and should your visa be cancelled? Extensions can be requested from the National Character Consideration Centre. Late information may still be considered if no decision has been made, but respond in time.
Grounds for cancellation (as listed)
Visa granted on a fact that no longer exists or never existed, breaching a visa condition, incorrect information or bogus documents, risk to public health, safety or good order, non-genuine students, identity concerns and a substantial criminal record.
What happens next?
Home Affairs prepares an issues paper for a decision-maker, who either cancels the visa or issues a warning.
Review rights
A delegate's cancellation can generally be reviewed at the ART. Review is not available where the Minister personally decides under section 501.
Policy change
It does not say whether Direction 123 applies to a notice issued earlier.
